Terms of Service

These terms govern your use of FinCanvas. By creating a workspace you agree to them. Plain English; if anything's unclear, email billing@themarketingtechnologists.com.

1. Who we are

FinCanvas is a SaaS project-costing tool provided by Aidan Perston, an independent self-employed professional trading as "The Marketing Technologists" ("we", "us", "our"). "You" and "your" refer to the workspace owner and any team members invited to your workspace.

2. The service

FinCanvas lets project-based businesses (construction sub-contractors, agencies, fit-out and fabrication shops, event production teams, and similar) build cost estimates, quotes, invoices, and branded PDFs through a visual canvas. The canvas, quotes, invoices, payment tracking, cost library, blueprints, custom fields per project, win/loss reports, and team management are the core of what you're paying for. Specific features evolve over time and we may add, modify, or remove individual features at any point.

We aim for FinCanvas to be available 24/7 but we don't guarantee uninterrupted service. We may need to take it down for maintenance, upgrades, or security work, and we'll try to give advance notice when we can.

3. Not financial or tax advice

FinCanvas is an administrative and calculation tool, nothing more. Every output it produces - estimates, quotes, invoices, margins, reports - is generated from the data you enter, and it's yours to check before you rely on it. We don't give financial, accounting, or tax advice, and the software's outputs are not advice.

For anything that depends on the numbers being right - pricing decisions, tax, VAT, your accounts - consult a qualified accountant or asesor fiscal. We are not your accountant or tax agent.

4. Your account and workspace

When you sign up, you create a workspace owned by your organisation. You're responsible for keeping your login secure and for what your team members do inside the workspace. If you think your account has been compromised, reset your password immediately and let us know.

You must be at least 18 years old to create a workspace. The workspace name, contact details, and any client data you enter should be accurate - quotes generated by FinCanvas may be sent to your customers, so it's your responsibility to make sure the numbers and details are right before sending.

5. Trial period

When you sign up we give you a 7-day free trial of the full FinCanvas Pro service. We require a payment method upfront to start the trial - this is industry standard for SaaS tools and lets us roll you onto a paid subscription cleanly when the trial ends.

You won't be charged during the trial. If you cancel before the trial ends, no charge is taken. If you keep the trial running until day 7, your card is automatically charged the monthly subscription fee on day 8 and your subscription begins.

6. Pricing and billing

FinCanvas Pro costs £15 per seat per month, or £126 per seat per year if you choose annual billing, for every team member with access to your workspace. Prices are in pounds sterling. We are not currently registered for UK VAT (turnover is below the £90,000 threshold), so no VAT is added at checkout. If our VAT status changes, we'll give you at least 30 days' written notice before VAT starts appearing on your invoices.

Subscriptions are billed monthly in advance. You authorise us to charge your payment method automatically on each billing date until you cancel. If a charge fails, we'll retry it for a short period; if all retries fail, your subscription will be cancelled and your workspace will move to read-only access (see Cancellation below).

We may change prices with at least 30 days' written notice. New prices take effect at your next billing cycle after the notice period; you can cancel during the notice period if you don't want to continue at the new price.

7. Cancellation

You can cancel anytime from the billing section of your workspace settings. Cancellation takes effect at the end of your current billing period - you keep full access until then.

After cancellation, your workspace becomes read-only for 60 days. You can still view, download, and export your existing projects, quotes, and PDFs during that window. After 60 days, your workspace and its data may be archived. If you want to come back, you can re-subscribe at any point during the read-only window to restore full access.

8. Refunds

Within 14 days of your first paid charge, we'll refund your most recent month's payment in full, no questions asked. The fastest path is via the in-app Billing Enquiry form (Settings → Billing → "Need help with billing or refunds") - it captures the workspace, charge, and reason in one go so we can issue the refund without an email back-and- forth. Alternatively, email billing@themarketingtechnologists.com with your workspace name. We'll process the refund within 5 working days either way.

After 14 days, refunds are at our discretion - we look at each case on its merits.

What's not refundable: payments older than 14 days; seat charges already invoiced for completed billing periods (the seat quantity charged is the number of team members on your workspace at the billing date - mid-period additions and removals are reconciled via Stripe proration on the next invoice, not refunded retroactively); and Stripe processing fees on the original charge.

Starting the service straight away. FinCanvas is a digital service supplied immediately. By starting your trial or subscription and using FinCanvas, you expressly request that we begin providing the Service to you right away, and you acknowledge that once the Service has been fully provided you may lose the statutory right to cancel that would otherwise apply during the 14-day cooling-off period. This does not affect any mandatory consumer rights you have, and our 14-day goodwill refund above still applies regardless.

The 14-day window aligns with your statutory right to cancel a digital service under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You can exercise that right via this refund policy or by contacting us directly. Your other statutory rights under the UK Consumer Rights Act 2015 are unaffected by this policy.

9. Acceptable use

You agree not to: (a) use FinCanvas to break the law or someone's rights; (b) try to break, probe, or reverse-engineer our systems; (c) attempt to access another workspace's data; (d) resell or sublicence the service to third parties without our written agreement; or (e) upload content that's defamatory, malicious, infringes intellectual property, or breaches data protection law. We may suspend or terminate workspaces that breach this clause.

10. Your data and content

You own the data you put into FinCanvas - projects, quotes, client records, line items, blueprints, everything. We just host it. By using the service you grant us the limited right to store, transmit, and process your data so we can provide the features you're paying for (e.g. generating PDFs, sending quote emails, displaying it back to you).

11. Your outputs and third-party reliance

Every output you create with FinCanvas - a quote, an invoice, a costing, a PDF - becomes your own document the moment you create or send it. You are its author and you are solely responsible for checking it is correct and for any decision anyone makes on the strength of it.

We make no representation, warranty, or assumption of responsibility to any third party (including your own clients) who receives or relies on an output you generate. No third party may treat an output as having been produced or verified by us - it wasn't; it's yours.

12. Our intellectual property

FinCanvas - the software, design, brand, and underlying architecture - belongs to us. You're licensed to use it under these terms while your subscription is active; nothing in these terms transfers ownership of FinCanvas to you.

13. Hosting

FinCanvas runs on third-party infrastructure: Supabase (database and authentication, with your data held in EU regions) and Cloudflare (application hosting and edge networking). The availability and performance of FinCanvas depend on these providers.

We are not liable for outages, failures, or data incidents caused by these providers, subject always to the Liability section below and to our Privacy Policy, which explains how your data is handled.

14. Liability

FinCanvas is provided "as is" and "as available", with no warranties of any kind beyond those that cannot be excluded by law.

We are not liable for any indirect or consequential loss arising from your use of (or inability to use) the service - including lost profits, business interruption, loss of data, or reputational harm.

Our total aggregate liability to you under or in connection with these terms will not exceed the total subscription fees you have actually paid us for the service. This cap applies to business customers.

Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under applicable law, including a consumer's non-excludable statutory rights under the Consumer Rights Act 2015.

15. Indemnity

You (the customer) agree to indemnify and hold us harmless against any claim, loss, or cost - including reasonable legal fees - brought by any third party (including your own clients) arising from: (a) your use of the service; (b) any output you generate, edit, send, or rely on; or (c) your breach of these terms.

16. Termination by us

We may suspend or terminate your workspace if you break these terms (especially clause 9 - Acceptable use), if a payment fails repeatedly, or if we have reason to believe your workspace is being used fraudulently. We'll generally try to warn you first and give you a chance to fix the issue, except where the breach is serious or unlawful.

17. Changes to these terms

We may update these terms from time to time. When we make a material change, we increment the version number shown at the top of this page and ask you to review and accept the updated terms before you continue using FinCanvas.

18. General

Severability. If any provision of these terms is found to be invalid or unenforceable, the rest stay in force.

Entire agreement. These terms (together with our Privacy Policy) are the entire agreement between you and us about FinCanvas, and replace any earlier understanding.

Assignment. You may not assign or transfer your rights under these terms without our agreement. We may assign or novate these terms - for example, to our future Spanish autónomo business - and we'll tell you if we do.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.

Notices. We'll send notices to the email on your workspace; you can reach us at billing@themarketingtechnologists.com.

No third-party rights. Nobody other than you and us has any right to enforce these terms - the Contracts (Rights of Third Parties) Act 1999 is excluded.

No service-level guarantee. These terms include no service-level agreement and no uptime guarantee.

Survival. Any provision that by its nature should survive the end of these terms - including the Liability, Indemnity, and intellectual-property clauses - continues to apply afterwards.

19. Governing law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. If you are a consumer, you keep the mandatory protections of the law of your country of residence - nothing here takes those away.
